1. GENERAL CONDITIONS
Access to and use of the site www.babybworld.com is subject to the terms and conditions below . By using the Site and related services that you agree to all the terms and conditions that may change over time .
It’s a customer responsibility to inform himself of any changes in conditions .
By placing an order , the customer declares to have read all the conditions and the information provided to him during the purchase process , you understand them and accept them entirely . I also declare to accept the terms of payment and delivery provided by BabyBWorld .
A contract for the sale of goods between BabyBWorld and the consumer (hereinafter “Customer”) is a distance contract under Article .50 et seq. Of Legislative Decree no . September 6, 2005 , 206 ( ” Consumer Code” ) and shall be concluded with the acceptance of the order by BabyBWorld . The acceptance will be sent to the email address BabyBWorld from the customer during the order
2. METHODS OF PURCHASE
The customer can buy all the products in the electronic catalogue of BabyBWorld. Once properly the procedure order and payment, a confirmation email will be sent to you at released during the purchase process.
The message will include all data entered by the customer agrees to verify the correctness and communicate any errors or corrections to the email address: firstname.lastname@example.org.
The invoice will be issued with the data provided by the customer when placing the order. No change in the bill will be possible after the issuance thereof.
In case the order is not accepted, BabyBWorld promptly notifies the cancellation of the order. In this circumstance, if the customer has already paid and this is already accredited, BabyBWorld provides for the immediate reversal of the order total. BabyBWorld reserves the right to cancel, without notice, orders untrusted.
The prices of the articles of BabyBWorld are expressed in Euros and include VAT.
4. DELIVERY CHARGES
For the deliveries in all the italian territory, the shipping is free of charge for order value over 70,00 euros.
For orders with value under 70,00 will be charged a cost of 8,00 euros.
For other European and non-European areas, the delivery can be made at the request of an estimate made by BabyBWorld and acceptance thereof by the customer.
The request must be sent to the email address email@example.com.
The customer should inquire about the presence and the amount of any customs charges applied in his country.
These charges will be borne by the customer.
5. METHODS OF PAYMENT
In case of purchase through Pay Pal, at the end of the order the customer will be directed to the PayPal login page.
The amount of the order will be charged to your PayPal account at the time of order .
In case of cancellation of the order , in the cases provided in accordance with procedures permitted by both the client and in the case of non-acceptance by BabyBWorld, the amount will be refunded to the customer’s PayPal account .
The cancellation is possible until the moment in which the same is not in evasion’s phase . The beginning of this stage is marked by the sending of an email from BabyBWorld to the customer and is reported in the personal account on www.babybworld.com.
After required annulment of the transaction, in no case BabyBWorld can be held liable for any damages, direct or indirect, caused by the delay in release of non committed by PayPal.
At no time during the purchase process BabyBWorld is able to know the financial information of the customer. The data are in fact disclosed by the customer directly to Paypal.
As there is no data transmission BabyBWorld by Paypal, there is no possibility that this data is intercepted or responsibility of BabyBWorld that remains foreign to the transmission. No archive of BabyBWorld contains or maintain such data since BabyBWorld does not receive them .
For each transaction made with your PayPal account, the customer will receive a confirmation email from PayPal.
Payment by credit card (VISA , MasterCard and Maestro) via a secure server operated by our bank institute.
BabyBWorld reserves the right to ask the customer additional information or sending copies of documents proving the ownership of the paper used. In the absence of the required documentation , BabyBWorld reserves the right not to accept your order.
At no time during the purchase process BabyBWorld is able to know the information about the buyer’s credit card, as they are typed directly on the site of the bank handling the transaction with high security systems. As there is no data transmission BabyBWorld by the bank, there is no possibility that this data is intercepted or responsibility of BabyBWorld that remains foreign to the transmission. No archive of BabyBWorld contains or maintain such data since BabyBWorld does not receive them.
In no event BabyBWorld can, therefore, be held responsible for any fraudulent use of credit cards by third parties, at the time of payment for products purchased on the sites.
6. METHODS OF DELIVERY
The date of delivery of the products to the customer will be notified by BabyBWorld depending on the timing of realization of the same.
Once delivered the goods to the courier, BabyBWorld sends an email to the customer with the tracking number, and in this way the customer can follow the path of the package until it will be delivered.
Since entrusted to the courier the package passes under the full responsibility of the latter both for what concerns the delivery time that the integrity of the package.
EXPENSES OF THE CUSTOMER AT THE TIME OF DELIVERY
Upon delivery of the goods by the courier, the customer must check that:
1 . the number of packages delivered corresponds to that indicated in the accompanying document .
2 . the items indicated on the pack corresponds to the one ordered
3 . packaging and the products inside are intact .
Any problems regarding the integrity of the products or completeness of the order received must be reported within 7 days after delivery by sending an email to firstname.lastname@example.org .
Once you have received the email BabyBWorld will then start practice for the replacement of the goods.
In case of damaged goods, in order to ascertain the presence and assess the extent of the damage, the customer must send the email email@example.com some digital photos and scanned copy of the accompanying bulletin issued by the courier.
Duepuntispazio no liability in case of damage not reported by following the above procedure.
7. RIGHT OF RETURN , REFUNDS AND EXCHANGES
If the customer is not satisfied with his purchase or want to change it, Duepuntispazio accepts returns and exchanges of goods.
To exercise the right of withdrawal, the customer must send to firstname.lastname@example.org a notice within 10 days of receipt of the goods. The subject of the email should be: “Returns ” .
The right of withdrawal is subject to the following conditions:
1. The returned product must not have been used and must be in original packaging.
2. The product must not have been damaged, soiled, washed or used and must be returned in full if it is accompanied by accessories .
3. Shipping charges both outbound and return flights are responsibility of the customer.
4. The expedition, until the return to BabyBWorld, is under responsibility of the customer .
5. BabyBWorld is not be liable for loss of returned products.
6. BabyBWorld is not liable for damages that the product may occur during transport at baggage.
7. BabyBWorld reserves the right to inspect the product before accepting the return.
If the customer receives a product other than ordered, please promptly notify the error to the email address email@example.com . Please also do not open the package. BabyBWorld will replace the product as quickly as possible .
The shipping costs for returns and exchange rates are charged to the customer .
Within 30 days of an inspection of the goods by BabyBWorld and in case of a positive outcome of the review, BabyBWorld will contact the customer to agree modalities and time of repayment of the amount paid by the customer.
8. AVAILABILITY OF PRODUCTS
BabyBWorld produces only by order and this justifies longer delivery times.
The website shows the expected delivery time for each product.
Delivery times are indicative, although usually respected, therefore BabyBWorld assumes no responsibility in case of delays of the same.
The failure to meet the delivery time does not justify the termination of the contract by the customer.
In no case can be placed against BabyBWorld damages caused by late delivery.
9. RIGHTS / CANCELLATION
Pursuant to Article 7 of the Privacy Code ( Article 7 of Legislative Decree 196/2003. ), the user has the right to obtain, at any time , confirmation of the existence of the data and the purposes for which they are used. Also they has the right to request the updating or the rectification, erasure or blocking of data and to object, in whole or in part, to their treatment.
At any time customer may request to read personal data in possession of BabyBWorld and request correction or deletion by sending a request to the email address firstname.lastname@example.org.
This contract of sale is concluded in Italy and governed by Italian law. For the solution of disputes arising from the conclusion, interpretation and execution of this Agreement , the territorial competence is exclusively under the Forum of Prato.
